Houston Proposes New Gas Station Siting Rules: Two-Step Review for New Retail Fuel Stations

HOUSTON, Texas — Houston city officials, in Harris County, Texas, presented a proposed Retail Fuel Station Ordinance to the City Council's Economic Development Committee on October 21, setting location standards for new gas stations. Houston has no traditional zoning, unlike other major Texas cities including Dallas, Austin and San Antonio, and has had no specific standards for gas station locations.
According to the city's presentation, officials reviewed 188 gas station applications submitted over the past four years in the Harris County portion of Houston: 95 percent (178) were on major thoroughfares, 52 percent (98) had homes within 50 to 100 feet of the proposed site, and 27 percent (50) were on roads 80 feet wide or narrower. Under the proposal, new applications would go through a two-step review: first, a site on a major thoroughfare wider than 80 feet would automatically qualify, while other sites move to a second review of surrounding residential properties — a site qualifies if less than 50 percent of the surrounding area is residential, and does not qualify at 50 percent or more unless the developer wins a variance. The ordinance would apply to future applications.
Months earlier, Riverside Terrace residents fought a proposed gas station and convenience store at 5204 Live Oak Street, near their homes; the city used that site as an example, noting the surrounding area is 100 percent residential within both 50 and 100 feet, so it would not qualify under the proposed rules. The ordinance has not been approved: the Planning Commission is scheduled to hear a presentation on November 12 and hold a public hearing on December 17, 2026, with City Council hearings and consideration in January 2027.
