New York City is a city in Queens County, New York. New York media reported on October 13-14 that, according to the Queens District Attorney's Office, Elvin Rivera, 57, allegedly drove a white Chevrolet Silverado pickup through a stop sign on 32nd Avenue in Murray Hill, Queens, at about 8:30 a.m. on Sunday, striking a nanny pushing a stroller. The 1-year-old boy inside, Justin Hu, was pronounced dead at a hospital, and the nanny suffered an injury to her right arm.

Prosecutors said Rivera stayed at the scene, allegedly had traces of cocaine and THC in his system and failed a field sobriety test, and had an open DWI case in the Bronx from an April incident. He was arraigned on Monday on charges including manslaughter, vehicular manslaughter, assault, driving under the influence of drugs, reckless driving and driving without a license.

Queens District Attorney Melinda Katz said in a statement that the loss was 'completely avoidable' and that her office would seek justice for the child and his family. The charges remain to be tried in court.
