Armstrong Issues Executive Order on Dyed Diesel Through Nov. 30

Thursday, October 1, 2026 · States · GSM News

[BISMARCK] North Dakota Gov. Kelly Armstrong signed an executive order on September 29 temporarily easing restrictions on dyed diesel use, effective immediately through November 30, northdakotamonitor reported. The move aims to relieve fuel-supply pressure on farmers during harvest season.

Dyed diesel is normally restricted to off-road uses such as farming and construction and is exempt from highway fuel taxes. The order allows expanded use under specified conditions to keep farm machinery fueled at the peak of harvest. The governor's office stressed the measure is a temporary emergency step that does not change long-term tax policy.

Farm groups welcomed the order, saying this year's fast-moving harvest has driven high fuel demand. The state tax department will issue implementation guidance spelling out eligibility conditions and record-keeping requirements.
