SEC Proposes Rule Allowing Advisers and Funds to Self-Custody Crypto Assets Under Set Conditions

Thursday, October 1, 2026 · Federal · GSM News

The U.S. Securities and Exchange Commission on October 1 issued a rule proposal (Release No. 2026-100) that would allow registered investment advisers and registered investment funds to self-custody crypto assets when specified conditions are met, and would confirm that state-chartered trust companies may serve as crypto asset custodians.

The roughly 760-page proposal was published in the Federal Register on October 6, with public comments due by December 7. It sets safeguard conditions for crypto custody, including segregation of assets, periodic verification and client disclosures.

SEC Chairman Paul S. Atkins said the proposal is designed to build a custody framework matched to the risks of crypto assets, allowing advisers and funds to use new custody arrangements while protecting investors. The proposal must go through the comment process and a Commission vote before it can become a final rule.
