Federal Judge Rules 3M's RICO Case Against Pike County Lawyer Over Black-Lung Claims Can Move Forward

PIKE COUNTY, Ky. — A federal judge ruled on Sept. 30 that mask maker 3M's Racketeer Influenced and Corrupt Organizations (RICO) lawsuit against a Pike County lawyer can move forward, WEKU reported on Oct. 3. 3M accuses the attorney of fraud in black-lung benefits claims.
3M, a major maker of respiratory protection equipment, alleged in its complaint that the lawyer used false medical diagnoses and inflated claims while representing coal miners seeking black-lung benefits. The company argued the pattern of fraudulent claims harmed its interests and amounted to organized fraud actionable under RICO.
The defense had asked the court to dismiss the case, arguing the allegations lacked merit. The judge found 3M's complaint sufficient to proceed to the next stage, stressing the ruling was procedural and not a judgment on the merits.
Black lung disease, caused by long-term coal dust inhalation, is a severe occupational illness prevalent in eastern Kentucky's coal country. Fraud disputes around black-lung claims have surfaced repeatedly in recent years, and the case is being closely watched by legal observers and the mining community.
