Colorado Court Hears Factory Farm Manure Permit Case Naming State as Defendant

A Colorado court held a hearing Oct. 13 in a lawsuit over groundwater and manure-management permits for factory farms, with Gov. Jared Polis's administration named as a defendant, Public News Service reported.
Environmental and community groups that brought the suit argue the state's manure permits fail to adequately assess the operations' impact on groundwater and are asking the court to review the permits' legality. The state is defending its permitting process.
Manure storage and land application at large livestock operations in Colorado have long been tied to disputes over nitrate contamination of groundwater, and the state environmental agency oversees the permits at issue.
The judge did not rule from the bench, and further proceedings will be scheduled by the court.
