Federal Appeals Court Hears Presidential Records Act Case as Justice Department Argues White House Files Belong to the President Personally

Friday, October 16, 2026 · Federal · GSM News

A federal appeals court in Washington heard arguments on Oct. 16 in the Justice Department's bid to nullify the Presidential Records Act. Government lawyers argued that the statute, enacted in 1978 after Watergate, is unconstitutional and that White House documents belong to Trump personally rather than to the American people; White House spokesperson Lauren Bis called the law unconstitutional and a clear violation of the separation of powers. U.S. District Judge John Bates ruled against the government earlier this year. The case is widely expected to reach the Supreme Court.
