DHS: Ukrainian and Sudanese TPS Holders Keep Protection Past Monday Expiry as Final Decision Awaited

Sunday, October 18, 2026 · Federal · GSM News

WASHINGTON — The Department of Homeland Security (DHS) told CBS News on Sunday, October 18, that Ukrainians and Sudanese enrolled in Temporary Protected Status (TPS) will retain their protection from deportation and their permission to work after Monday, October 19, the date both designations were set to expire.

DHS said final decisions on the two programs will be made at the appropriate time, and that until then, enrolled nationals retain protection. As of Sunday, DHS had not published an extension or termination notice in the Federal Register, and had issued no new document that employers can file when verifying work authorization.

Extension notices published by DHS in January 2025 estimated about 103,700 Ukrainian beneficiaries and about 1,900 Sudanese beneficiaries eligible to re-register, roughly 105,600 people in total. TPS is a humanitarian protection for nationals of countries where returning is temporarily unsafe; it shields holders from removal and provides work permits, but does not by itself lead to permanent residence.

The approach mirrors DHS's handling of El Salvador, whose TPS designation expired on September 9 without a final decision announced beforehand, with enrolled holders' protections remaining in place in the interim. The final outcome for Ukraine and Sudan awaits a further DHS announcement. (GSM, from CBS News reporting)
