17 Groups Sue Montana PSC, Saying Utility Regulation Must Consider Climate Risks

Sunday, October 18, 2026 · States · GSM News

HELENA — Seventeen organizations have sued the Montana Public Service Commission (PSC) in Missoula County District Court, asking the court to rule that the commission has a constitutional duty to consider climate risks when regulating gas and electric utilities. The complaint was filed on October 15 by Earthjustice and the Western Environmental Law Center.

The case grows out of a February 2024 petition by more than forty organizations, which the PSC rejected in September 2025 and again on September 15, 2026. The commission's counsel argues it is an administrative agency without authority to interpret the state constitution; the plaintiffs cite the Montana Supreme Court's December 2024 ruling in Held v. Montana, which affirmed a constitutional right to a clean and healthful environment. (GSM, based on multiple media reports)
