California Judicial Council Considers Felony Sentencing Rule Revisions Effective Jan. 1, 2027

The Judicial Council of California's Oct. 16 meeting agenda included proposed revisions to the state's felony sentencing rules (Item 26-142), recommended by the Criminal Law Advisory Committee. The proposal amends California Rules of Court 4.420 and 4.421 and addresses recent appellate decisions on prior convictions, aggravating circumstances and judicial discretion in selecting prison terms.
The proposed amendment to Rule 4.420 would clarify that judges retain discretion over the weight given to an aggravating circumstance even when it has been properly pleaded and proved, and would clarify use of prior convictions following the state Supreme Court's 2025 decision in People v. Wiley. The committee describes the changes as clarifications of existing authority. If adopted as proposed, the amendments would take effect Jan. 1, 2027; as of Oct. 15 they remained pending.
