Labor Department Issues Field Assistance Bulletin on Tipped Employees, Withdrawing Three Opinion Letters

WASHINGTON — The U.S. Department of Labor's Wage and Hour Division on October 19 issued Field Assistance Bulletin No. 2026-1, addressing the related duties of tipped employees. With the bulletin, the division withdrew three prior opinion letters on the subject and terminated a memorandum of understanding concerning tip pools. The division said the bulletin is intended to provide consistent guidance to its field staff and clear direction for industries, such as restaurants, that employ large numbers of tipped workers. Field assistance bulletins are enforcement guidance documents issued to the division's investigators; they do not themselves create new legal obligations but shape how the agency assesses employer compliance.
