Delaware THC Beverage Law Takes Effect October 21: Sales Allowed at Licensed Liquor Stores and Marijuana Dispensaries

Tuesday, October 20, 2026 · States · GSM News

Delaware's new law regulating THC (tetrahydrocannabinol) beverages takes effect on Wednesday, October 21, allowing approved businesses to manufacture, distribute and sell the drinks through licensed liquor stores, marijuana dispensaries and certain microbreweries.

The law, established under House Bill 373 and signed on July 23, creates a regulated market for nonalcoholic beverages containing delta-9 THC. According to the Delaware Office of the Marijuana Commissioner, the products are subject to requirements covering potency, testing, labeling, packaging and distribution. Sales are restricted to adults 21 and older, and consumption at the point of sale is prohibited. On potency, individual containers may contain up to 10 milligrams of THC, multipacks a combined maximum of 60 milligrams, and larger 750-milliliter bottles up to 170 milligrams. The beverages may not contain alcohol, and the THC must come from qualifying delta-9 extracts.

Unlike traditional marijuana products, which are generally restricted to licensed dispensaries, the new framework extends sales to liquor stores and authorized microbreweries. Businesses must first obtain the appropriate state authorizations, so the law taking effect does not mean products will be on shelves at every eligible retailer on Wednesday. On licensing, manufacturers and importers seeking a standard infused beverage endorsement face an initial application fee of $1,500 and a $1,000 renewal fee; qualifying social equity and microbusiness applicants pay reduced fees of $600 and $400. The state will also tax the drinks at $0.50 per single-serving container and $8.50 per 750-milliliter bottle, but those tax provisions do not take effect until February 1, 2027.

The law follows Delaware's launch of legal adult-use marijuana sales in August 2025 and establishes a separate retail channel for THC beverages. (GSM, based on Delaware Office of the Marijuana Commissioner rules and House Bill 373)
