DOJ Settles With Village of Atlantic Beach, N.Y., Over Zoning Code That Disfavored Religious Land Uses

Wednesday, October 21, 2026 · Justice · GSM News

The U.S. Department of Justice announced on October 21 that it has reached an agreement with the Village of Atlantic Beach, New York, resolving allegations that the village's zoning code violated the Religious Land Use and Institutionalized Persons Act (RLUIPA). The department said the code treated religious assembly uses less favorably than comparable secular assembly uses.

Assistant Attorney General Harmeet K. Dhillon and Joseph Nocella Jr., U.S. Attorney for the Eastern District of New York, issued statements emphasizing that local governments may not discriminate against religious groups in land-use decisions. Atlantic Beach is a village on the south shore of Long Island in Nassau County, New York. The terms of the agreement are set out in the department's published text.
