Ninth Circuit Pauses Arizona Prison Health Care Takeover Pending State Appeal

Wednesday, October 21, 2026 · States · GSM News

A federal appeals court has paused a court-ordered takeover of Arizona's prison health care system while the state appeals. The Ninth Circuit's order, issued late Friday, halted a handover originally set for October 19 in the long-running case Jensen v.

Thornell. U.S.

District Judge Roslyn Silver had appointed Annette Chambers-Smith on July 17 as the court receiver to run prison health care, at a salary of $500,000, after finding the state had failed for years to meet constitutional standards of care. The ACLU, which first sued over prison medical conditions in 2012, opposed the stay.

The pause keeps the existing arrangement in place while the appeal proceeds and does not decide the merits of the receivership. Arizona officials have argued the takeover oversteps federal court authority over a state prison system.
