U.S. Supreme Court Declines to Hear Challenge to Maine's 72-Hour Gun Purchase Waiting Period

Wednesday, October 21, 2026 · States · GSM News

The U.S. Supreme Court has declined to review a challenge to Maine's 72-hour waiting period for gun purchases, leaving the law in effect.

The First Circuit upheld the waiting period in April, and the justices' refusal to hear the case ends this round of litigation. Maine enacted the waiting period after the October 25, 2023 mass shooting in Lewiston; Governor Janet Mills allowed it to become law without her signature.

U.S. District Judge Lance Walker had issued an injunction against the law in February, which the appeals court later reversed.

Attorney General Aaron Frey defended the statute on appeal. Gun rights groups said they would continue challenging waiting period laws in other cases.
