EU Court Upholds 'Iberian Mechanism', Dismissing Appeals Over Spanish-Portuguese Power Price Measure

Friday, October 23, 2026 · World News · GSM News

LISBON — The European Court of Justice on October 22 dismissed appeals and upheld the legality of the "Iberian mechanism" power price cost measure applied by Spain and Portugal, ruling that it does not constitute discriminatory state aid. The challengers included PGI Spain, Berry Superfos and RPC Envases.

The Iberian mechanism dates from the 2022 energy price crisis, when Spain and Portugal, with EU approval, intervened in the price of natural gas used for power generation in order to lower wholesale electricity prices and ease bills for businesses and households.

The ruling confirms the mechanism's legal standing. Companies that had sued over energy costs failed to overturn the earlier decision, giving judicial backing to the electricity price intervention adopted by the two Iberian countries during the crisis.
