Fourth Circuit Upholds Army Corps Wetlands Permit for 9,076-Acre Cainhoy Development Near Charleston

The U.S. Department of Justice announced on October 23 that the U.S. Court of Appeals for the Fourth Circuit has upheld a permit issued by the U.S. Army Corps of Engineers under Section 404 of the Clean Water Act for the Cainhoy Plantation development, a residential and mixed-use project near Charleston, South Carolina.
According to the Justice Department, the permit authorizes development on portions of a 9,076-acre property. The project includes housing, schools, medical facilities and community services, and will permanently conserve thousands of acres of land.
Adam Gustafson, Principal Deputy Assistant Attorney General for the Environment and Natural Resources Division, welcomed the ruling in the department's statement. The Justice Department noted that, over years of review, the Corps reduced the project's projected wetlands impacts from 1,820 acres to 181.5 acres, a reduction of nearly 90 percent.
