Justice Department Issues Status Notice on Fiscal 2026 Section 330(e) Payments to Chapter 7 Trustees

Tuesday, October 27, 2026 · Justice · GSM News

The U.S. Department of Justice has issued a notice on the status of payments under 11 U.S.C. Section 330(e) for fiscal year 2026. The payments provide eligible Chapter 7 bankruptcy trustees up to $60 per case in additional compensation, funded by excess collections in the U.S. Trustee System Fund. (GSM, based on the Justice Department notice and Administrative Office of the U.S. Courts materials)

According to the Administrative Office of the U.S. Courts, the additional payment, created by the Bankruptcy Administration Improvement Act of 2020, is paid on top of standard trustee compensation, with each year's available amount determined by the fund balance and the number of new and converted Chapter 7 cases. Because the Bankruptcy Administration Improvement Act of 2025, signed on February 6, 2026, removed Section 330(e) and related provisions, fiscal year 2026 will be the final year for which these payments may be issued; for Chapter 7 cases filed on or after October 1, 2026, total trustee compensation permanently increases to $120 per case.
