Bismarck, Burleigh County, North Dakota: Insurance Department Notifies 25 Pharmacy Benefit Managers on October 29 of Suspected Unlicensed Activity, Gives 20 Days to Apply for Licenses

The North Dakota Insurance Department in Bismarck, Burleigh County, announced on October 29 that Insurance Commissioner Jon Godfread has notified 25 pharmacy benefit managers (PBMs) of apparent unlicensed activity in North Dakota. The companies must submit a complete license application within 20 days of receiving the notice, or face cease-and-desist orders and further penalties and fines. PBMs are intermediaries between insurers, pharmacies and drug manufacturers; they influence prescription drug pricing, coverage and pharmacy reimbursement, affecting what residents pay for medications and the ability of local pharmacies to serve their communities. The department said it has information indicating the companies are operating in the state without the license required by state law. PBMs that submit a complete application within the 20-day period will have their applications processed in the ordinary course and will not receive a cease-and-desist order; those that fail to meet the requirements will receive one. The enforcement follows House Bill 1584, passed by the 2025 Legislative Assembly, which established a dedicated PBM division within the department and expanded the commissioner's authority to investigate and enforce state PBM laws.
