Indianapolis, Marion County, Indiana: Governor Braun's Administration Rejects Death Row Inmate Weisheit's Brain Scan Request on Oct. 29: Parole Board Unanimously Recommended Denying Clemency the Same Week

Indiana Governor Mike Braun's administration decided on October 29 not to allow death row inmate Jeffrey Weisheit to undergo additional brain scans before his execution scheduled for the following week. Braun's general counsel, Stephanie Flittner, met with Weisheit's legal team on Wednesday to discuss the testing and his pending clemency request, but the administration ultimately did not approve it. Weisheit's attorney Joseph Perkovich had written to Braun requesting that Weisheit be transported to Franciscan Health in Michigan City for MRI and PET scans, so that University of Pennsylvania neuropsychologist Ruben Gur could assess whether Weisheit's brain injuries preceded his 2010 murders of 8-year-old Alyssa Lynch and her 5-year-old brother Caleb. Indianapolis psychiatrist R. Andrew Chambers also supported the request, saying modern imaging could help distinguish earlier injuries from one Weisheit suffered during his arrest. The Indiana Supreme Court last week refused to postpone Weisheit's November 5 execution or order his transport for testing, but said the executive branch could authorize the scans without court approval. Also on Wednesday, the Indiana Parole Board unanimously recommended that Braun deny the request to commute the death sentence to life in prison. Braun has not yet announced his final clemency decision.
