The U.S. Attorney's Office for the District of Connecticut announced that Rudy Antonys Barrientos-Avila, 38, a citizen of Honduras, waived his right to be indicted and pleaded guilty before U.S. District Judge Sarah F. Russell in New Haven to unlawful reentry of a removed alien.

According to court documents and statements made in court, on December 27, 2012, U.S. Border Patrol agents in Hidalgo, Texas, arrested Barrientos-Avila and charged him with illegal entry into the United States. He pleaded guilty in the Southern District of Texas, was sentenced to time served, and was removed to Honduras on February 13, 2013.

On December 24, 2018, Border Patrol encountered Barrientos-Avila in Hidalgo after he had illegally reentered the country, and he was deported to Honduras on January 4, 2019. He illegally reentered again: on March 20, 2025, Stamford Police arrested him on charges of possession of a controlled substance and breach of peace in the second degree, and on September 25, 2025, Stamford Police arrested him on charges including attempted assault on public safety personnel, possession with intent to sell a narcotic substance, criminal trespass in the second degree, breach of peace in the second degree, and interfering with an officer. Those state cases remain pending in Stamford Superior Court.

Barrientos-Avila was located and arrested on September 29, 2026, and has been detained since. Sentencing has not been scheduled; he faces a maximum term of imprisonment of two years.

The case was investigated by U.S. Immigration and Customs Enforcement's Enforcement and Removal Operations and is being prosecuted by Assistant U.S. Attorney Michael S. Deel. Prosecutors said the case is part of Operation Take Back America, a nationwide Justice Department initiative.
