Follow-Up: Judge Tosses Olivier Martinez's Restraining Order Request Against Halle Berry; Custody Setup Stays for Now

Saturday, October 31, 2026 · Culture & Entertainment · GSM News

According to Page Six, Los Angeles Superior Court Judge Shelley Kaufman on Thursday, October 29, lifted the temporary restrictions imposed on actress Halle Berry and tossed out her ex-husband Olivier Martinez's request for a domestic violence restraining order, ending a nine-day hearing in the custody dispute over their 13-year-old son, Maceo, in Los Angeles, Los Angeles County, California.

The ruling does not change the current custody setup: Martinez will retain the physical custody outlined when his temporary restraining order was granted, while he and Berry continue to share legal custody. The arrangement will be discussed again at a court hearing next month.

Berry's attorney Marina Beck told Page Six the legal team was extremely pleased the court dissolved the temporary order, and that Berry remains focused on the well-being and best interests of her family. Martinez's attorney did not immediately respond to a request for comment.

Martinez, who was granted a temporary protective order on October 1, had accused Berry of choking their son during a September 26 altercation and sought sole physical and legal custody; Berry has consistently denied the allegations. During the hearing, Maceo gave nearly four hours of sealed testimony on October 19, his therapist and a school official also took the stand, and Berry's 18-year-old daughter Nahla Aubry and her fiancé Van Hunt testified in the closed proceedings.

Berry and Martinez married in July 2013, separated two years later, were declared legally single in December 2016 and finalized their divorce in August 2023.
