Monday, November 2, 2026 · Justice · GSM News

Elkins, in Randolph County, West Virginia, saw a fentanyl case move forward on November 2: a man from Augusta, in Hampshire County, pleaded guilty in federal court to selling fentanyl in a business parking lot.

The defendant, Johnny Foster Biggs, 47, of Augusta, pleaded guilty on November 2 to distribution of a fentanyl analogue. U.S. Attorney Matthew L. Harvey announced the plea.

According to court documents, Biggs sold 3.339 grams of a fentanyl mixture to someone in a business parking lot in Elkins. As part of the plea agreement, Biggs agreed to forfeit a pistol and ammunition associated with the case.

Biggs faces up to 30 years in prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors; no sentencing date was announced in the release.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Mountain Region Drug Task Force, a HIDTA-funded initiative. Assistant U.S. Attorney Stephen Warner is prosecuting the case on behalf of the government, and U.S. Magistrate Judge Michael John Aloi presided.

The Justice Department said the case is part of Operation Take Back America, a nationwide initiative to achieve the total elimination of cartels and transnational criminal organizations, protect communities from the perpetrators of violent crime, and repel the invasion of illegal immigration.
