Federal Judge Refuses to Stay Grant Termination Ruling, Chides Government for Slow-Walking Case

Tuesday, November 3, 2026 · Justice · GSM News

A federal judge in Boston, Suffolk County, Massachusetts, on November 3 rejected a federal government request to stay an earlier judgment in a grants case. The judgment held that the government cannot terminate already-awarded federal grants based solely on the president's current priorities. In the ruling, the judge pointed to intentional slow-walking by the government side as the case proceeded, and declined to alter the judgment through a stay.

The case concerns the scope of federal authority to terminate grants, and whether funding already promised and awarded can be halted unilaterally when policy direction changes. The judge's position means that, while the litigation continues, the earlier bar on terminating grants on that ground remains in effect, and affected recipients will not lose that protection because of this stay request. Further developments depend on the appellate process and additional proceedings.
