Charlotte Felon Convicted in Two Shooting Cases: Kenneth Fuller Faces Up to 15 Years Per Count for Possessing Ammunition

Wednesday, November 4, 2026 · Justice · GSM News

A federal jury in Charlotte, North Carolina, has convicted Kenneth Fuller, 43, of Charlotte, on two counts of possession of ammunition by a convicted felon, U.S. Attorney Russ Ferguson for the Western District of North Carolina announced. U.S. District Judge Kenneth D. Bell presided over the three-day trial.

According to trial evidence, on December 20, 2024, Fuller argued with employees at a Waffle House in Charlotte, claiming he had paid too much and demanding a refund, then fired a handgun into the air before returning to his black Maserati sedan and driving off. Charlotte-Mecklenburg Police Department officers recovered a single discharged .40 S&W caliber casing in the grass at the scene.

About two weeks later, on January 3, 2025, Fuller argued with employees over a food order at the Market Express in Charlotte and left, then returned in the same black Maserati at about 7:10 a.m. and fired two times at one of the store employees before fleeing. Officers recovered two .40 S&W shell casings and found two bullet holes in the windowpane to the left of the store's door.

Fuller was arrested on January 13, 2025, seated in the driver's seat of the same black Maserati. Trial evidence showed the casings from both incidents were fired from the same firearm. Fuller has multiple prior felony convictions in North Carolina, including for distribution of cocaine, and is prohibited from possessing a firearm or ammunition.

U.S. Attorney Russ Ferguson said Fuller shot into two businesses while employees and patrons were present, endangering innocent life. ATF Special Agent in Charge Alicia Jones said law enforcement partners will continue to hold accountable those whose behavior puts the community at risk. The case was investigated by the ATF and the Charlotte-Mecklenburg Police Department and prosecuted by the U.S. Attorney's Office in Charlotte.

Fuller faces a statutory sentence of up to 15 years in federal prison per count. A sentencing date has not been set. (Source: U.S. Department of Justice)
