Arkansas Attorney General Sues Prediction Market Kalshi, Alleging Illegal Gambling

Arkansas Attorney General Tim Griffin announced in Little Rock on Nov. 4 that he has filed a lawsuit against prediction market platform Kalshi, alleging it operates illegal gambling in the state. The defendants are KalshiEX LLC and Kalshi Inc. In a statement, Griffin said Kalshi allows consumers to wager on the outcome of elections, reality competition shows, football games and much more, which is gambling, and gambling on an unregulated platform is prohibited by Arkansas law.
Griffin alleges violations of the Arkansas Deceptive Trade Practices Act, and the relief sought includes restitution, penalties, taxes and injunctive relief. He said Kalshi is not blind to the real risks its platform presents to users, including excessive wagering, financial losses, depression and other mental health harms, noting the platform offers self-exclusion tools, deposit limits and trading breaks commonly associated with gambling operators and promotes gambling addiction resources.
Kalshi has previously argued in other lawsuits that its event contracts are derivatives regulated by the Commodity Futures Trading Commission and therefore not subject to state gambling laws. Arkansas joins a growing list of states taking legal action against prediction markets.
