West Virginia attorney general sues Snap over child safety, My AI chatbot

Thursday, November 5, 2026 · Justice · GSM News

West Virginia Attorney General JB McCuskey filed suit on November 5 in Kanawha County Circuit Court against Snap Inc., the maker of Snapchat, alleging the company deceived parents and children about the platform's safety while knowing it exposed young users to sexual exploitation, harmful content and compulsive-use design.

The consumer protection lawsuit also alleges Snap rushed its 'My AI' chatbot to all users, including minors, without adequate safety testing, and misled families about what the chatbot does with private conversations and location data. The suit was filed a day before the first anniversary of the death of Bryce Tate, a 15-year-old Nitro High School student who was targeted in a sextortion scheme on Snapchat on November 6, 2025, and died hours later. The state also announced a sextortion education campaign with the Bryce Tate Memorial Foundation. The attorney general seeks an injunction, civil penalties and court-ordered safety changes.
