West Virginia Felon Caught With Two Loaded Pistols Sentenced to 10 Years in Federal Prison

The U.S. Attorney's Office for the Southern District of West Virginia announced on November 5, 2026, that Eddie Daivon Morgan, 45, of Mount Hope, West Virginia, also known as "Gutta," was sentenced to 10 years in prison, to be followed by three years of supervised release, for being a felon in possession of a firearm.
According to court documents and statements made in court, on November 30, 2022, law enforcement officers who held an active arrest warrant for Morgan on a malicious wounding charge saw him enter a vehicle in Fayette County, conducted a traffic stop, and found Morgan lying in the back seat. Officers seized a loaded Glock model 42 .380-caliber pistol and a loaded SCCY 9mm pistol from his person.
The warrant followed a November 18, 2022, confrontation between Morgan and another person at a Fayette County residence. After a verbal altercation escalated, Morgan threatened to "shoot the place up" and later fired two rounds from a .380-caliber pistol, wounding the other person in the arm. Morgan pleaded guilty in Fayette County Circuit Court on March 28, 2024, to attempted second-degree murder, malicious assault, wanton endangerment involving a firearm, and use or presentation of a firearm during the commission of a felony.
Federal law prohibits anyone with a prior felony conviction from possessing a firearm or ammunition. The Justice Department said Morgan knew he was prohibited because of his January 24, 2013, conviction in the Southern District of West Virginia for using a communication facility to facilitate a drug trafficking offense. His criminal history also includes prior convictions for second-degree manslaughter, second-degree assault, felony escape, wanton endangerment with a firearm, possession with intent to deliver a controlled substance within 1,000 feet of a school, battery, and domestic battery.
U.S. Attorney Moore Capito announced the sentence and commended the work of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Oak Hill Police Department. U.S. District Judge Irene C. Berger imposed the sentence, and Assistant U.S. Attorney JC MacCallum prosecuted the case, No. 2:23-cr-92. The case is part of Operation Take Back America and Project Safe Neighborhoods (PSN).
