Flushing Driver Who Killed 1-Year-Old Chinese-American Boy Indicted on 12 Counts

Friday, November 6, 2026 · Justice · GSM News

Elvin Rivera, 57, of Flushing, has been indicted by a grand jury on 12 counts, including second-degree manslaughter, second-degree vehicular manslaughter, second-degree assault, driving without a licence and driving under the influence of drugs, Queens District Attorney Melinda Katz announced on November 6. The charges stem from the October 11 crash that killed 1-year-old Justin Hu.

Prosecutors say that at about 8:35 a.m. on Sunday, October 11, Rivera drove a white Chevrolet Silverado north on Murray Street, rolled through the stop sign at 32nd Avenue without stopping, accelerated through the intersection and struck the stroller being pushed by the baby's nanny, who suffered an injured arm. Rivera allegedly had cocaine and THC in his system and had an open DWI case in the Bronx from April 2026. DA Katz called the loss 'heartbreaking' and 'completely avoidable'. An indictment is an accusation, and the defendant is presumed innocent until proven guilty.
