South Dakota AG Jackley Rules Deputy's Use of Force Justified in Shooting That Also Killed a Fellow Deputy

Sunday, November 8, 2026 · Justice · GSM News

SIOUX FALLS, South Dakota — South Dakota Attorney General Marty Jackley announced on November 6 that, after a review by the state Division of Criminal Investigation, a Minnehaha County deputy's use of force in an October 9 officer-involved shooting in Sioux Falls was justified. That day, three county deputies went to a Sioux Falls residence to serve a mental-health custody order on 39-year-old Brandon Oatken when gunfire broke out. Deputy Katherine Frank was fatally wounded in the incident and died on October 12. The Attorney General's Office said the DCI has completed its review and reached its conclusion, and the investigative report has been released for the public to read in full. The ruling means the deputy involved will not face criminal charges over the incident.
