Follow-Up: CNN, MS NOW and Politico Expand Lawsuit Over White House Access Limits, Saying They Are Still Barred From Press Pool Despite Judge's Orders

Wednesday, October 28, 2026 · White House · GSM News

CNN, MS NOW and Politico on Oct. 28 expanded their lawsuit challenging President Donald Trump's efforts to ban them from the White House, according to Reuters. In an amended complaint, the three outlets said that even after a judge ordered their access restored, they have continued to face retaliation for their news coverage.

The media companies asked a federal judge in Washington to prevent the White House from barring them from serving in the press pool that covers the president at close quarters in places such as the Oval Office and aboard Air Force One.

U.S. District Judge Timothy Kelly has, since Sept. 24, issued orders requiring the Trump administration to reinstate White House access for journalists from the three organizations, and earlier this month the court extended that protection in the form of a preliminary injunction while the case proceeds.

The companies said in the new filing that despite Kelly's orders, the administration has continued to bar them from certain areas, in violation of the speech protections of the First Amendment to the U.S. Constitution. The White House said in a statement: "The Fake News has no place demanding a spot in the President's Oval Office."
