Follow-Up: Judge Denies Olivier Martinez Bid to Reopen Evidence in Halle Berry Restraining Order Hearing on October 27; Testimony Continues October 28

The restraining-order hearing between Halle Berry and her ex-husband Olivier Martinez continued on October 27 at the Stanley Mosk Courthouse in Los Angeles, Los Angeles County, California, where Judge Mark Juhas denied Martinez's motion to reopen the evidentiary portion of the case. The hearing resumes on October 28, when Martinez is expected to continue his testimony.
According to People and Just Jared, Martinez sought to call Berry and her therapist, Dr. Tricia Leavitt, and to introduce new exhibits, including text messages from 2021 to 2023 that he says support his claim that Berry was the abuser in the relationship. The judge denied the request.
The hearing centers on the domestic violence restraining order Berry obtained against Martinez in June 2026 and extended in July, which bars him from contacting Berry, their 12-year-old son Maceo, and Berry's fiancé, singer Van Hunt. In her filing, Berry alleged violent and erratic behavior, including threats to kill her, her head being slammed into a marble floor and choking, and said Maceo witnessed some of the incidents. Martinez denies all allegations and filed his own restraining-order request in September, accusing Berry of fabricating claims to support changes to their custody arrangement; his request was denied. Berry's attorney Laura Wasser said in a statement that Martinez is projecting his abuse onto Berry and called his claims pure fabrication.
Earlier in the hearing, Berry's 18-year-old daughter Nahla testified remotely on October 26, and Van Hunt testified on October 23. Closing arguments are expected on October 29 and 30. Berry and Martinez married in 2013 and divorced in 2016; they share custody of Maceo, and Berry pays $8,000 a month in child support.
