Austin Woman Sues Torchy's Tacos Over Cow Tooth Found in Taco, Seeks Up to $250,000

Austin is a city in Travis County, Texas. An Austin woman has sued local chain Torchy's Tacos after finding a cow tooth in a takeout taco, according to reports by FOX 7 Austin, KVUE and USA Today on October 16. Nohemi Castillo filed the lawsuit on October 13 against Torchy's Tacos and Success Foods Management Group LLC, which does business as Torchy's Tacos.
The filing stems from a June 9 incident at the chain's location at 1822 S. Congress Ave. in Austin, where Castillo ordered a Democrat taco made with beef barbacoa. She alleged she nearly swallowed the object, was sickened by the discovery, and saw a doctor that evening, receiving prescription medication. Castillo is seeking up to $250,000 in damages, alleging negligence, breach of implied warranties and violations of the Texas Deceptive Trade Practices Act and the federal Food Safety Modernization Act. Her attorney, Scott Vasquez, said the tooth should have been detected before the food reached the customer.
A Torchy's spokesperson confirmed to KXAN and KVUE that the object was a cow tooth, saying the company's barbacoa comes from natural beef cheek sourced from a supplier and that such incidents can occur during meat processing but are rare. The company said it has worked with its supplier to reinforce internal procedures. The case is pending in court.
