Luigi Mangione Charged With Stalking and Murdering UnitedHealthcare CEO: Four Federal Counts, One Punishable by Death

Thursday, December 19, 2024 · Justice · GSM News

The U.S. Attorney's Office for the Southern District of New York announced on December 19 the unsealing of a federal criminal complaint charging Luigi Nicholas Mangione, 26, in connection with the December 4 murder of UnitedHealthcare executive Brian Thompson in Midtown Manhattan, New York City, New York. Mangione was taken into federal custody that day and was presented that afternoon in Manhattan federal court before U.S. Magistrate Judge Katharine H. Parker.

The complaint charges four counts: using a firearm to commit murder, which carries a maximum potential sentence of death or life in prison; interstate stalking resulting in death, which carries a maximum of life in prison; stalking through use of interstate facilities resulting in death, which carries a maximum of life in prison; and discharging a firearm equipped with a silencer in furtherance of a crime of violence, which carries a maximum of life in prison and a mandatory minimum of 30 years. The charges in a complaint are merely accusations, and Mangione is presumed innocent unless and until proven guilty.

As alleged in the complaint, over the course of several months Mangione meticulously planned the execution of Thompson in an effort to initiate a public discussion about the healthcare industry. He targeted Thompson, tracked his whereabouts, and traveled from out of state to New York City, where Thompson was scheduled to attend the company's investor conference. After arriving on November 24, 2024, more than a week before the murder, Mangione performed reconnaissance around the victim's hotel and the conference venue, and checked into an Upper West Side hostel using a false identification.

In the early morning hours of December 4, 2024, Mangione traveled by bicycle from the Upper West Side to the area around West 54th Street and Sixth Avenue. At approximately 6:45 a.m., he placed himself between two cars on West 54th Street and, as Thompson passed by, walked up behind him and fired several gunshots from a 9mm pistol equipped with what appeared to be a silencer, causing Thompson's death. He then fled on his bicycle northbound through Central Park and back to the Upper West Side.

On December 9, 2024, Mangione was arrested in Altoona, in Blair County, Pennsylvania, while sitting in a fast-food restaurant after being recognized by one of the restaurant's workers. Altoona police confronted him; he provided the same false identification he had used at the New York hostel, and he was also found in possession of a 9mm pistol and a sound suppressor consistent with the weapon used to kill Thompson.

Acting U.S. Attorney Edward Y. Kim said Thompson was gunned down in cold blood as he walked down a street in Midtown Manhattan and was allegedly killed just because he held the position of chief executive officer of a health insurance company, adding that this was not a debate but murder. Attorney General Merrick B. Garland said Mangione allegedly planned his attack for months and stalked his victim for days, and thanked state and local law enforcement partners for locating and apprehending him.

According to the Justice Department, the Manhattan District Attorney's Office has brought a separate state prosecution against Mangione, which is currently expected to proceed to trial before the federal case. The case is being investigated by the FBI's Violent Crimes Task Force and the NYPD, and is being prosecuted by Assistant U.S. Attorneys Dominic A. Gentile, Jun Xiang, and Alexandra Messiter.
