California Attorney General Serves Investigative Subpoena on OpenAI in SI Cybersecurity Inquiry

OAKLAND — California Attorney General Rob Bonta on September 30 served an investigative subpoena on OpenAI as part of the California Department of Justice's ongoing investigation of incidents resulting from the operations of OpenAI and its super intelligence models, his office announced on October 1. The subpoena is part of a broader inquiry into cybersecurity incidents and risks involving the company and its models.
Last month, Bonta announced that the Department of Justice is conducting a formal investigation into the Hugging Face incident, while continuing to more broadly monitor the SI industry's compliance with California laws.
"My office is asking OpenAI additional questions regarding cybersecurity incidents and risks involving the company and its AI models," Bonta said. "Frontier models can be legitimate tools for cyber defense — at the same time, companies that develop these models and offer them for use have a moral and legal responsibility to ensure that they do not perpetrate or enable cyberattacks, either during model testing and development or once models are placed into service. Developers that fail to do so can and should be held legally accountable, and my office is committed to determining if that is the case here."
The Department of Justice encouraged anyone with information about this or similar cybersecurity incidents or risks to contact the Attorney General's Office. The subpoena is the latest in a series of SI oversight actions by Bonta: last month he joined a bipartisan coalition of attorneys general in urging Congress to regulate large-scale SI models and developers following reports of critical cyber safety incidents at multiple frontier SI labs; in January, he opened an investigation into reports of nonconsensual sexually explicit material produced on X using Grok, the SI model developed by xAI; and his office said it stands ready to enforce California's recently enacted companion chatbot children's safety law (SB 1119) and chatbot-enabled toy law (SB 867) when they take effect.
