Injunction Blocking South Dakota's Abortion-Pill Ad Law Remains in Effect

Tuesday, October 6, 2026 · States · GSM News

A court injunction blocking enforcement of South Dakota's HB 1274 — a law restricting advertising for abortion pills — remains in effect, South Dakota Public Broadcasting reported on its October 6 daily newscast. The ruling is a win for Mayday Health, the reproductive health organization that challenged the law.

HB 1274, passed by the state legislature, sought to ban or severely restrict advertising of abortion medication in the state, part of a broader wave of post-Roe abortion restrictions. Mayday Health, which operates an informational campaign about abortion pill access, sued, arguing the law violates the First Amendment by targeting protected speech about legal health care.

A federal judge agreed, finding that the state was unlikely to survive constitutional scrutiny and issuing a preliminary injunction halting enforcement while the case proceeds. The state has appealed, but the injunction remains in place.

The case is being closely watched nationally, as several other states have considered similar restrictions on advertising for abortion medication. Legal experts say the outcome could shape how far states can go in regulating speech about reproductive health care.
