Follow-Up: 18 Attorneys General Back South Dakota's Appeal in Abortion Pill Case

South Dakota Attorney General Marty Jackley announced in Pierre on October 22 that the attorneys general of 18 states have filed an amicus brief with the U.S. Court of Appeals for the Eighth Circuit supporting South Dakota's appeal in an abortion pill case. As reported on October 6, a federal district court's preliminary injunction remains in effect, temporarily barring the state from enforcing a new law that would criminalize the advertisement, dispensing and distribution of abortion pills in South Dakota that do not meet medical and legal standards. In July, the U.S. District Court in Rapid City ruled in favor of Mayday Health, which had requested the preliminary injunction; South Dakota appealed, and a trial on the merits is anticipated in 2027.
The 18 states joining the brief are Alabama, Arkansas, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, South Carolina, Tennessee, Texas and West Virginia. 'I appreciate my fellow Attorneys General who agree that individual States have the right to protect against dangerous pills that don't meet medical and legal standards,' Jackley said. 'Our States understand the importance of States' rights and honoring our State law.' The full brief is posted on the South Dakota Attorney General's Office website.
