Austria's Administrative Court Rejects Challenge to the ORF Household Fee

Friday, October 9, 2026 · World News · GSM News

A long-running legal dispute over the funding of Austrian public broadcaster ORF has produced a landmark ruling. In a decision dated September 2, 2026 (case Ra 2025/15/0009), Austria's Administrative Court (VwGH) dismissed a challenge to the ORF contribution, holding that the device-independent household levy in force since 2024 does not breach EU state-aid rules, and upholding the legislature's monthly setting of the fee for the transition period. On Friday, October 9, ORF Director General Ingrid Thurnher publicly welcomed the ruling, and the Federal Administrative Court (BVwG) issued a statement on its significance.

The ORF contribution replaced the old GIS licence fee on January 1, 2024, shifting from a device-based charge to a household levy of 15.30 euros per month, payable regardless of whether a household uses ORF services. The Constitutional Court had already ruled the contribution constitutional on June 24, 2025, in a case arguing that the duty to pay even without using ORF violated the equality principle. The Administrative Court's ruling addressed a separate set of questions, on state aid and the transition-period fee.

Thurnher said on October 9 that the central objections to the ORF contribution had now been settled at the highest judicial level and that the financing of public broadcasting stood on a legally secure footing, adding that solidarity-based contribution funding strengthens ORF's independence.

BVwG President Christian Filzwieser said in the court's statement that the decision was a first important confirmation of the Federal Administrative Court's case law. Figures released by the court show that complaints against fee assessments issued by the ORF Beitrags Service GmbH have surged since the new law took effect: more than 8,500 new proceedings were registered in the 2024 and 2025 business years, and more than 3,800 further cases have been filed since the new business year began in February 2026 — a total of roughly 12,400 proceedings, of which nearly 65% had been completed as of September 23, 2026. The court noted that some questions, including the contribution's business-sector rules, remain open.

The Administrative Court also confirmed that the Federal Administrative Court may dispense with an oral hearing where a case raises only legal questions already covered by supreme-court or EU case law and no disputed questions of fact.
