California Sues ICE Over Civil Arrests at Courthouses, Citing APA and Tenth Amendment

Thursday, October 15, 2026 · California · GSM News

SACRAMENTO — California Attorney General Rob Bonta announced that California has filed suit in federal court challenging Immigration and Customs Enforcement's practice of making civil immigration arrests in and around California courthouses, arguing it violates the Administrative Procedure Act and the Tenth Amendment, and seeking declaratory and injunctive relief.

Court administrators, district attorneys and immigrant advocates joined the announcement. Bonta's office cited cases including a domestic violence survivor who abandoned an application for a restraining order for fear of an ICE arrest at court, and witnesses refusing to testify. Bonta said courthouse arrests are eroding public trust in the justice system and making communities less safe.
