California DOJ Releases Report on Officer-Involved Shooting of Jesse Dominguez; Evidence Insufficient to Support Criminal Charges

LOS ANGELES — California Attorney General Rob Bonta on October 16 released a report, in accordance with Assembly Bill 1506 (AB 1506), on the officer-involved shooting that killed Jesse Dominguez in Los Angeles on November 19, 2023. The incident involved officers from the California Highway Patrol (CHP). After an extensive investigation, the California Department of Justice (DOJ) concluded that the evidence does not support filing criminal charges in the case, and no further action will be taken.
According to the report, on Sunday, November 19, 2023, a CHP officer responded to a 911 call reporting a pedestrian walking in the traffic lanes of westbound Interstate 105 near the Wilmington Avenue offramp in the City and County of Los Angeles. Upon contacting Mr. Dominguez, the officer asked him to put his bags down and show his hands. Mr. Dominguez did not comply and continued to walk away. As the officer attempted to handcuff him, a fight broke out and Mr. Dominguez shocked the officer with a stun gun. The officer then fatally shot Mr. Dominguez.
Under AB 1506, DOJ is required to investigate all officer-involved shootings resulting in the death of an unarmed civilian in the state. DOJ concluded that the evidence does not show, beyond a reasonable doubt, that the officer acted without the intent to defend himself and others from what he reasonably believed to be imminent death or serious bodily injury. Therefore, there is insufficient evidence to support a criminal prosecution of the officer.
DOJ identified two recommendations. First, CHP should provide additional training on operational safety tactics, including using time, distance, and cover when attempting to detain a non-compliant individual when an officer is acting alone. Second, CHP should provide additional training on the legal standard for when deadly force is authorized based upon an imminent threat of death or serious bodily injury, under Penal Code section 835a, subdivision (c)(1)(A).
Attorney General Bonta said in a statement that incidents like these are always tragic, and that he hoped the report would help bring clarity to the community and those personally impacted, adding that his office's goal is to foster a system that protects the rights of individuals and promotes trust and accountability between law enforcement agencies and California communities.
