Gov. Spanberger Asks Regulators to Reject the Dominion-NextEra Merger Unless the Companies Accept a Six-Year Rate Freeze
Virginia Governor Abigail Spanberger filed expert testimony with the State Corporation Commission on October 19 asking regulators to reject NextEra Energy's acquisition of Dominion Energy unless the companies accept her conditions: a six-year freeze on residential base electricity rates, monthly customer bill credits raised to nearly triple — $29 a month for four years — and stronger, enforceable commitments on worker and consumer protections. The testimony also calls for adjusting the debt share of Dominion's capital structure, changing how certain system costs are allocated, expanding protections against service disconnections, and requiring specific investment commitments in energy efficiency, distributed energy and locally generated power.
The case, numbered PUR-2026-00112 before the commission, is set for a hearing beginning November 17. Spanberger formally joined the proceeding as a respondent in August, giving her the right to submit evidence and cross-examine the companies' witnesses.
The acquisition is valued at about $67 billion.
The governor's expert, Richard McCann, concluded that the commitments the companies have made so far are insufficient to establish that "just and reasonable rates" will be protected. The same day, commission staff also recommended rejecting the merger as currently proposed, citing unresolved concerns about "reliable service at reasonable prices." Whether the merger is approved, and on what conditions, will be decided by the State Corporation Commission, not the governor.
