California DOJ Releases Report on Los Angeles Deputy Shooting of Martin Sebastian: No Criminal Charges

California Attorney General Rob Bonta on October 20 released an investigative report under Assembly Bill 1506 (AB 1506) into the March 16, 2024 fatal shooting of Martin Sebastian by Los Angeles County Sheriff's Department (LASD) deputies in Los Angeles, in Los Angeles County, California. After a comprehensive investigation, the California Department of Justice (DOJ) concluded that the evidence does not support filing criminal charges in the case, and no further action will be taken.
According to the report, on March 16, 2024, LASD deputies responded to a call about a man with a handgun causing a disturbance outside El Tio Tono Market in Los Angeles. When the deputies arrived, Sebastian pointed his firearm directly at them, and the deputies immediately fired, fatally striking him. After the shooting, it was discovered that Sebastian's firearm was a replica.
DOJ said the evidence does not show, beyond a reasonable doubt, that the deputies acted without the intent to defend themselves and others from what they reasonably believed to be imminent death or serious bodily injury, and that there is therefore insufficient evidence to support a criminal prosecution. "Loss of life is always tragic, and we hope that this report provides Mr. Sebastian's family and the community closure," Bonta said, adding that his office's priority is to protect the rights of individuals while fostering trust and accountability between law enforcement and Californians, and that AB 1506 is crucial to that goal.
AB 1506 requires DOJ to investigate all officer-involved shootings resulting in the death of an unarmed civilian in California. DOJ identified three recommendations for LASD in this case: amend its body-worn camera policy and provide additional training on camera activation and on what discussions are permitted and prohibited during debriefs after a deputy-involved shooting; provide further training to ensure deputies involved in a shooting understand and comply with sequestration policies; and amend its policy and provide further training on the preservation of evidence related to deputy-involved shootings.
