Federal Judge Halts DHS Election-Related Operations: Nevada and Eight Other States Protected by Injunction Until Voting Ends

Judge Araceli Martinez-Olguin of the U.S. District Court for the Northern District of California issued a preliminary injunction on Wednesday, Oct. 21, barring the Department of Homeland Security from conducting election-related field operations in Nevada and eight other states that could sweep in U.S. citizens, with the injunction lasting until voting ends on Election Day. Nevada media reported the ruling on Oct. 24, citing the Nevada Current. The lawsuit was brought by the City of San Francisco, Santa Clara County, the California Nurses Association, National Nurses United and the Latino Vote Foundation, alleging that DHS sent armed personnel door to door to question residents about their voter status. The judge wrote that the evidence was sufficient to make people "objectively reasonably fear entanglement with law enforcement and thus refrain from urging or assisting others to exercise their right to vote," and that the importance of protecting citizens' ability to vote free from intimidation outweighed the government's interest in investigating noncitizen voting. The injunction covers California, Connecticut, Georgia, Missouri, Nevada, New York, Pennsylvania, Washington and Wisconsin; the judge stayed its effect until Friday, Oct. 23, to allow the federal government time to appeal. The ruling is seen as a legal setback for the Trump administration's fall campaign against noncitizen voting.
