USCIS Weekend Rollover Rule Takes Effect Oct. 23: Day-Count Paper Deadlines Still Roll Over, Age-Based Cutoffs No Longer Do

Sunday, October 25, 2026 · Federal · GSM News

U.S. Citizenship and Immigration Services (USCIS) put a new method of calculating filing deadlines into effect on October 23: for paper filings, a deadline stated in a specific number of days still rolls to the next business day when its last day falls on a Saturday, Sunday or federal holiday; deadlines tied to age or other substantive eligibility requirements no longer roll over, and electronically filed applications receive no extension either.

The change comes from USCIS Policy Alert PA-2026-15, "Definition of Day for Purposes of Filing Deadlines," issued on September 23, which revises Section E of Chapter 6, Part B, Volume 1 of the USCIS Policy Manual, applies to paper filings received on or after October 23, and reverses the agency's more lenient March 2023 guidance. The alert draws a line between two kinds of deadlines. Deadlines counted in days — such as the 30- or 33-day periods for appeals and motions — remain timely for paper filings received by the end of the next business day when the last day falls on a weekend or holiday. Deadlines defined by a birthday or age — such as the requirement that a Special Immigrant Juvenile (SIJ) petitioner be under 21 when filing — do not move: USCIS must receive the filing before the birthday, even if the birthday falls on a weekend or holiday. The same day, USCIS designated Matter of Borges Borsoi as a precedent decision, reaffirming that the agency's receipt date controls. Electronic filings are treated as received the moment they are submitted, so no weekend or holiday extension applies.

For Chinese applicants and families in the United States, the most direct impact falls on households with a child approaching 21 and on paper filers: there is no grace period on age cutoffs, so filings should be made well in advance, and applications that can be filed online should be submitted by the deadline day rather than left to Monday. This article is general information only and is not legal advice for any individual case; applicants should rely on their own notices and counsel for specific deadlines.
