South Dakota to Receive $2,600,792 in GM Data Settlement Announced Oct. 30: Driving Data Sold to Insurers Without Drivers' Knowledge; State One of 36 in the Deal

South Dakota Attorney General Marty Jackley announced on October 30 that South Dakota will receive $2,600,792 from a settlement with General Motors over its practice of tracking and selling driver information. GM, without telling drivers, sold driving-behavior and location data to data brokers, which resold it to insurance companies for use in setting rates. South Dakota is one of 36 states in the settlement.

Under the settlement, consumers can request a copy of their data and ask for it to be deleted. Jackley's office said the payment responds to an invasion of drivers' privacy and that automakers may not turn driving data into insurance-pricing material without drivers' knowledge.
