U.S. Supreme Court Asks Washington State to Respond by November 27 in Cap-and-Invest Case; PacifiCorp Says the Program Discriminates Against Out-of-State Customers

Olympia, Thurston County, Washington — The U.S. Supreme Court has asked Washington State to respond to PacifiCorp's petition in the cap-and-invest case, with a response deadline of November 27; the petition is scheduled to be distributed to the justices for their November 6 conference, according to news released on October 27. PacifiCorp filed the petition on September 4, asking the Supreme Court to take up its dispute over Washington's cap-and-invest program; the company argues the program discriminates against utilities that supply power to customers outside Washington. Washington Department of Ecology Director Casey Sixkiller had waived the right to respond on October 13 through the state attorney general's office, but the high court is now seeking a response. The cap-and-invest program is Washington's market-based tool for controlling greenhouse gas emissions, and the core of the dispute is whether it treats cross-border power supply unfairly. Whether the Supreme Court formally takes the case will become clear after the November 6 conference; any ruling will be as announced by the court.
