Summersville, Nicholas County, West Virginia — The U.S. Environmental Protection Agency's Region 3 issued public notices on October 27 proposing to enter into consent agreements and final orders with the Central Supply Company of West Virginia to settle alleged Clean Water Act violations at three facilities. The Summersville facility, at 7900 Webster Road, faces a proposed $60,000 penalty; the Westover facility, at 1300 Morgantown Industrial Park Road, a proposed $55,000 penalty; and the Mabscott facility, at 97 Hill Street, a proposed $295,000 penalty — $410,000 in total. The EPA says the amounts were calculated under Section 309(g) of the Clean Water Act, the March 1, 1995 interim settlement penalty policy, the statutory penalty criteria and factors, and the rules adjusting civil monetary penalties for inflation. The company has an office address in Bridgeport; the three cases carry docket numbers CWA-03-2027-0001, 0002 and 0003, each with a different permit number. The penalties are proposals at this stage; the public may comment through the notice process, and the final orders will be as the EPA subsequently publishes them.
