West Virginia's Daniel's Law Ruled Unconstitutional by Fourth Circuit, a First for a Federal Appeals Court

Tuesday, October 27, 2026 · States · GSM News

WEST VIRGINIA — The US Court of Appeals for the Fourth Circuit ruled on October 27 that West Virginia's Daniel's Law — which bans publishing the home addresses and unlisted phone numbers of judges and law enforcement officers online — is unconstitutional. It is the first time a federal appeals court has struck down such a law.

The case stems from a class action brought by retired law enforcement officer Michael Jackson against data companies including Thomson Reuters, Whitepages, Thryv, PeopleConnect and LexisNexis. The law is named for Daniel Anderl, the son of federal Judge Esther Salas, who was killed in 2020; West Virginia enacted its version in 2021.
