Follow-Up: Texas Fifteenth Court of Appeals Stays Order Opening Abbott's Communications With Musk to Hinojosa

Austin, Texas — The Office of the Governor of Texas said in a statement on October 28 that the Texas Fifteenth Court of Appeals has stayed a Travis County district court order, meaning the governor's office is not required for now to give State Representative Gina Hinojosa access to Governor Greg Abbott's communications with businessman Elon Musk. The appeals court also ordered Hinojosa to respond to the governor's office's motion to dismiss the lawsuit.

Hinojosa had sued Governor Abbott seeking access to his communications with Musk. The Travis County district court had ruled that the governor's office must allow her to inspect the records; the governor's office appealed and moved to dismiss the lawsuit in its entirety.

Andrew Mahaleris, a spokesperson for the governor's office, said in the statement: "This lawsuit is a baseless stunt and nothing more than an act of desperation. State Representative Gina Hinojosa is abusing her official capacity as an outgoing lawmaker for political purposes. The Office of the Governor's appeal automatically halts the trial court judge's order, and the Office has filed a motion to dismiss the baseless lawsuit in its entirety."
