Two San Jose Officers Charged With Evidence Tampering and Filing a False Report

Saturday, October 31, 2026 · City · GSM News

Two officers of the San Jose Police Department, in the City of San Jose, Santa Clara County, California, are facing criminal charges: Raydarius Surry, 29, and Destiney Thompson, 30, surrendered to authorities on October 28, each charged with tampering with evidence and filing a false police report, in a case stemming from a piece of evidence that was never logged after an arrest this May.

Prosecutors allege that in a May 3 arrest, a baggie of suspected narcotics recorded in Surry's report was never logged into evidence; then, on August 12, after learning the discrepancy had been noticed, Surry allegedly seized a similar baggie from an unrelated pedestrian, let the person go with no documentation, and logged that bag under the May 3 case. Thompson, who is in a relationship with Surry, allegedly helped plan the cover-up. Both officers have been on paid leave since September 2026.

San Jose Police Chief Paul Joseph said the department moved quickly once the issue came to light. The officers' cases have also been referred to the California Commission on Peace Officer Standards and Training (POST) for a temporary decertification review. The allegations remain charges at this stage, to be determined in court.
